📘According to Article 2, Section 3a of Regulation (EU) 2023/956 of the European Parliament and Council, dated May 10, 2023, which establishes the Carbon Border Adjustment Mechanism (CBAM), 👉 goods with and actual value not exceeding 💰150 EUR are exempt from CBAM reporting obligations during the transitional period.
🤔 But what does „actual value” mean? Does it include transport and insurance costs?
👉 The answer lies in the regulations! The definition of the actual value of a shipment can be found in Article 1, Point 48 of the Delegated Regulation for the Union Customs Code (UCC), and it states: ⏺ for commercial goods: the price of the goods sold for export to the customs territory of the Union, excluding transport and insurance costs unless included in the price and not itemized on the invoice, and excluding any other taxes and fees that customs authorities may determine based on appropriate documentation. ⏺ for non-commercial goods: the price that would be paid for the goods if they were sold for export to the customs territory of the Union.
ℹ️ The CBAM reporting exemption applies to the goods’ value indicated in the commercial document, regardless of the delivery terms, and does not include additional costs for transport or insurance (even if listed separately on the invoice or other documents).
❗️However, if the price of the goods includes these costs, they cannot be deducted.
